FAQ's for Employees My employer told me I have to find a SAP? How do I do this? First, your employer is responsible for giving you the names & phone numbers of qualified SAPs. They may not charge for the names. If I have a violation, do I have to go through a SAP? Yes. DOT regulations require you to be assessed by a qualified and treained SAP. What if I arrange for an assessment by someone who is not a SAP? An employer cannot accept the recommendations from anyone that is not qualified and trained per DOT regulations. My employer gave me the name and phone number of a SAP. Must I use that SAP, or can I find another SAP? What is your company policy? If there is not a policy regarding this matter, you should ask your employer. DOT holds your employer responsible for the qualifications of its Third Party Administrators (TPA). What if I just go to a treatment center and put myself into treatment? This is not permissible under DOT regulations. Your employer’s records must include an evaluation and recommendations, as well as a follow-up assessment by a SAP What happens if I just quit this job and apply to another employer? Your new employer is required to obtain your drug screen results from you former employer for the last two years. What if I just “forget” to list my previous employer on an application form? Falsification of information is a serious offense and may be subject to fines and penalties. Who is going to pay for the cost of my SAP services? DOT does not designate who is responsible. You may have to pay. Will my treatment be covered by my health insurance? Possibly not. The SAPs recommendations may not be covered by your insurance plan or approved by your managed care provider. If I don’t agree with the SAP's recommendation, can I get a second opinion from another SAP? No. DOT does not allow “SAP shopping”. Can I find out what this follow-up testing program will be? No. This is confidential information. Who pays for these follow-up tests? This is an employer’s decision. DOT does not specify. What happens if I test positive on a follow-up test? You must go through the whole process again.
